Refund and Cancellation Policy

Superscript Inc ("Company", "we", "our", or "us") operates BoinkAI ("Platform"), accessible via web or browser at www.boinkai.com ("Services"). BoinkAI is an AI-powered chat platform allowing users to interact with virtual, fictional characters ("Companions") for personalized conversations, including sexually explicit content behind a paywall. This Refund and Cancellation Policy outlines the terms for canceling subscriptions and requesting credits for our Services, in compliance with the California Consumer Privacy Act (CCPA) and other applicable US laws.

Superscript Inc, registered at 30 N Gould St Ste R, Sheridan, WY 82801, is responsible for processing cancellations and credits. This policy applies to all users, who must be at least 18 years old.

Restricted Access

The Services are not available to users in the European Union, United Kingdom, or South Korea due to regional privacy regulations. We kindly request that users in these regions refrain from accessing the Services or attempting to circumvent restrictions.

1. Subscriptions and Auto-Renewal

Certain features, including sexually explicit content, require a paid subscription. Subscription tiers, fees, and billing terms are disclosed at purchase. We accept payments via credit/debit cards and cryptocurrencies (subject to change; currently only Bitcoin is offered).

  • Credit/Debit Cards: Subscriptions are billed automatically on a monthly or annual basis. Your payment method will be charged the applicable fee at renewal unless canceled.
  • Bitcoin Payments: Subscriptions require manual payment via monthly or annual invoices sent by us. You must send Bitcoin to the wallet address, link, or QR code displayed on www.boinkai.com  at checkout. Warning: Never send payments to addresses received via phone, text, or email-only, as these may be fraudulent. We are not liable for payments sent to incorrect or unauthorized addresses.

You are responsible for ensuring accurate payment information and compliance with Know Your Customer (KYC) and Anti-Money Laundering (AML) regulations. Payments are considered complete only after sufficient blockchain confirmations for Bitcoin (e.g., 6 confirmations), as determined by us. You acknowledge the irreversible nature of cryptocurrency transactions and assume all risks associated with price volatility, network fees, and transaction errors.

2. Cancellation Policy

You may cancel your subscription at any time via your account settings on www.boinkai.com. Cancellation takes effect at the end of the current paid term (monthly or annual), and you will retain access to paid features until the term ends. No refunds are issued for the current term, but you may contact us for potential credits (see Section 3).

  • How to Cancel: Log in to your account, navigate to the subscription settings, and select "Cancel Subscription." You will receive a confirmation email. Cancellations must be processed directly through our platform.
  • User Responsibility: You are responsible for canceling before the next billing cycle (for credit/debit cards) or invoice due date (for Bitcoin) to avoid charges. We send renewal reminders or invoices via email, but it is your duty to manage your subscription. Failure to cancel in time does not qualify for credits.
  • Bitcoin Payments: Ensure you cancel before the invoice due date, as Bitcoin transactions are irreversible once confirmed on the blockchain.

Free features (e.g., limited Companion interactions) are available without a subscription, allowing you to explore the Services before committing.

3. Refund and Credit Policy

Due to the nature of our Services, including immediate access to digital content and operational costs incurred upon use, we do not offer refunds for subscription fees paid for the current term, whether paid via credit/debit cards or Bitcoin. Our goal is to ensure customer satisfaction, and we encourage you to contact contact@boinkai.com to discuss extenuating circumstances (e.g., significant service disruptions) for potential credits toward future subscriptions.

  • No Refunds: Refunds are not granted for:
    • User dissatisfaction with content (e.g., Companion responses not meeting expectations).
    • Failure to cancel before auto-renewal or invoice due date.
    • Partial use of the subscription term.
    • User errors (e.g., incorrect Bitcoin wallet address, unconfirmed blockchain transactions).
    • Violations of our Terms (e.g., prohibited content, underage access).
    • Bitcoin payments, due to their irreversible nature.
  • Credit Requests: In exceptional cases, we may offer credits at our sole discretion. Requests must be submitted within 14 days of the issue date (e.g., date of service disruption) and include:
    • Your account email and username.
    • Subscription details (e.g., tier, purchase date).
    • Detailed explanation of the issue.
  • Credit Processing: We will review requests and respond within 14 days. Approved credits will be applied to your account for future subscriptions within 10 business days. Credits are non-transferable and have no cash value.
  • Bitcoin Payments: No refunds or credits are issued for payments sent to incorrect or unauthorized wallet addresses. Only use addresses, links, or QR codes shown on www.boinkai.com.

4. Chargebacks and Disputes

We encourage you to contact us at contact@boinkai.com before initiating a chargeback with your credit/debit card provider, as chargebacks incur a $100 administrative fee, plus additional liability for damages, including legal fees, for all chargebacks (per Terms, Section 7). If you retract a chargeback after we resolve your issue, the fee may be waived.

Chargebacks for Bitcoin payments are not applicable due to transaction irreversibility, but disputes over unconfirmed or misdirected payments will be reviewed case-by-case. We reserve the right to suspend or terminate accounts for chargeback or dispute abuse.

5. KYC/AML Compliance

For credit requests or disputes, we may require additional documentation (e.g., ID, proof of funds) to comply with KYC/AML regulations, especially for Bitcoin payments. Failure to provide documentation may result in credit denial or account suspension. We may report suspicious transactions to authorities as required.

6. Third-Party Processors

Credit/debit card payments are handled by third-party payment processors, whose policies may affect billing or dispute resolution. We are not responsible for delays, fees, or denials caused by their processes. Review their terms before subscribing. Bitcoin payments are processed directly by us and are not subject to third-party policies.

7. Taxes

You are responsible for all applicable taxes associated with your subscription. Credits issued may be adjusted to account for taxes withheld or paid, as required by law.

8. Account Termination

Canceling your subscription does not automatically delete your account. To request account deletion, contact contact@boinkai.com, subject to our Privacy Policy's data retention periods (30 days for chat logs, 12 months for account data). Accessing the Services after cancellation requires a new subscription.

9. Changes to This Policy

We may update this policy at our sole discretion. Check www.boinkai.com/refunds for the latest version. Material changes will be notified via email. Continued use constitutes acceptance (per Terms, Section 18).
